PREAMBLE

These general conditions of sale govern all relations between JUCH SARL, a company with a capital of €2,000 whose registered office is located at 9 avenue de la Liberté, 92400 COURBEVOIE, FRANCE registered in the Paris Trade and Companies Register under number 810 332 255, (hereinafter referred to as “the company”) and customers of the www.juch.fr site (hereinafter referred to as “customer”) wishing to make a purchase via the website (hereinafter referred to as “the website”). The Client declares that he/she has the capacity to conclude this contract, i.e. to have reached the legal age of majority and not to be under guardianship. The order by the Customer implies the irrevocable acceptance of these general terms and conditions of sale. The sales contract is subject to French law.

ARTICLE 1: ACCEPTANCE OF THE CONDITIONS

Any order placed on the site implies the customer’s unconditional and irrevocable acceptance of these conditions. The site is the property of the company in its entirety, as well as all related rights. Any reproduction, in whole or in part, is prohibited without the express prior written consent of the company. The general terms and conditions of sale may be modified, in particular by considering possible changes in names. The new general terms and conditions of sale will apply on the date they are published on the site.

ARTICLE 2: PRODUCTS

The products are those listed on the site. These products are offered for sale within the limits of available stocks. The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions may have occurred with respect to this presentation, the company may not be held liable. Photographs illustrating the products in support of the text do not fall within the scope of the contract. JUCH could, due to its suppliers, be required to deliver to the Customer an item of a slightly different composition from that described but in any case of a quality equal to or better than the item ordered.

ARTICLE 3: ORDERS

The automatic registration system is considered as proof of the nature, content and date of the order. The company confirms the acceptance of its order to the customer at the e-mail address that the customer has provided. The sale will only be concluded once the order has been confirmed. The company reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information provided by the customer when placing the order is binding on the customer: in the event of an error in the wording of the recipient’s contact details, the company cannot be held liable for any inability to deliver the product. The items visible on the site are available while stocks last. In the event of a debit or collection for an unavailable item, the company undertakes to offer a credit note or refund the customer within 15 days and to notify by e-mail the customer who has placed an order for an unavailable item.

ARTICLE 4: RATES

Items will be invoiced on the basis of the rates in effect at the time of order registration. The products remain the property of the company until the full price has been received by the company. This price is payable in full and in a single payment. The prices are indicated in euros all taxes included. They take into account the VAT applicable in France on the day of the order; any change in the rate may be reflected in the price of the products or services. The price indicated in the order confirmation is the final price, expressed inclusive of all taxes and including VAT for France and European Union countries. This price includes the price of the products, handling and packaging costs, as well as transport and insurance costs. The company reserves the right to modify its prices at any time, without notice and in particular in the event of a change in tax or economic data. Items will be invoiced on the basis of the prices in effect at the time the order is placed.

ARTICLE 5: PAYMENT METHOD & SECURE PAYMENT

Our secure payment offer – CM-CIC PAYMENT

When buying on the Internet with Cic Secure Payment, the entire transaction is carried out on the CM-CIC banking site in encrypted mode. The credit card number is entered on a secure page hosted by the bank. The information is encrypted (SSL technology). The card number is never printed in full on payment invoices. We will never know your card number. What security does CM-CIC use p@iement? CM-CIC p@iement uses the standard encryption system called “SSL protocol”. It is concretized, when you are on the payment page, by:

– A pictogram in a corner of your browser: one of these signs must be present: The lock must be closed.

– In the address bar of your browser, the browser is in “https://” mode instead of “http://”.

– When you switch from unencrypted to encrypted mode (and vice versa), browsers display a message warning you of the change. Check these elements before entering confidential data, it is a guarantee of security.

In order to use the most powerful protocols, we recommend the use of a state-of-the-art browser.

What information is required to use CM-CIC P@iement? On the CM-CIC website p@iement, we will ask you:

– Credit card or private card number (15 or 16 digit numbers)

– The expiry date

– The visual cryptogram (last 3 or 4 digits on the signature strip of your card)

We apply the new safety standards in France. It aims to authenticate the cardholder when paying by internet. This standard is referred to as “Verified by Visa” for Visa and “MasterCard SecureCode” for MasterCard. Its principle is based on the verification of information known only by the cardholder (such as the 4-digit code) and which will be requested by his bank during web transactions. With the deployment of 3D Secure (recognizable with logos), your bank will also ask you to authenticate yourself during payment with confidential information to be entered on a web page of your own bank or through codes sent to your mobile phone.

In any case, JUCH cannot be held responsible for hacking and only your bank can guarantee your transactions by sending you personal and unique codes. The company also offers its customers the possibility to pay for their purchases using Paypal.

ARTICLE 6: DELIVERY

JUCH shoe orders placed before 2pm (GMT+1) Monday to Friday are shipped the same day (except holidays). Orders placed after 2pm are shipped the next business day. This period is given as an indication and remains subject to the actual receipt of payment.

The shipments are then handled by a transport service provider (Colissimo) who ensures the transport to the delivery address indicated by the customer. The delivery times indicated by the carriers are as follows:

METROPOLITAN FRANCE

Free delivery of your JUCH pair: within 48 to 72 hours.

INTERNATIONAL

Free delivery of your pair of JUCH in Europe: D+5 to D+7

Fixed price delivery (10€) in the rest of the world: D+10 to D+15

All these deadlines are given as an indication. Exceeding these deadlines may under no circumstances be held against JUCH, nor give rise to termination of the contract or any compensation for damages.

Warnings / advice: Only the damages and anomalies mentioned in the reservations made by the customer will be taken into account in the resolution of the dispute by the transport service provider. The company reminds that in the event of a delivery problem, the customer must keep all the elements received in the same condition (including packaging and overpacking) until the complete resolution of his file.

Any failure to comply with the rules defined above may result in the transport service provider refusing to take charge of the dispute. We advise you to check your delivery address when summarizing your order. In case of error on the delivery address, the shipping costs for a new shipment will be charged to the customer.

The customer must submit to the company, within two working days following the date of receipt of the package, any claim of error of delivery and/or non-conformity of the products in kind or in quality with respect to the indications appearing on the order form. Any complaint made after this deadline will be rejected without any possibility of recourse for the customer and will release the company from any liability towards the customer.

If the country of delivery is not part of the European Union, customs duties will be charged to the recipient. JUCH has no control over these costs, which are the sole responsibility of the Customer. Delivery errors: In the event of a delivery that is not intended for the customer, the customer is required to keep the package(s) in good condition and to inform the company’s customer service department at :contact@juch.fr

Non-conforming products: In the event of a non-compliant product, the customer may make this complaint in accordance with the terms and conditions to the company’s customer service department. The company will do its utmost to regularize the problem encountered by the customer as soon as possible. In these specific cases and to the extent that the error emanates from its services.

Warnings / advice: The customer is informed that certain documents related to the package(s) may be requested and must therefore remain in possession of all the elements received (including packaging and overpacking) until the complaint has been fully resolved.

All announced deadlines are in working days (excluding Saturdays, Sundays and public holidays). The company delivers worldwide. We cannot guarantee delivery times, but the usual delivery times are 2 to 4 working days in metropolitan France and 5 to 7 working days for Europe, and 10 to 15 days for the rest of the world. The company uses the post office and its shipments by Colissimo for the whole world. Customs and other charges in the country of arrival are the responsibility of the customer. In case of unusual delays, an e-mail will be sent to you. Shipping costs are calculated automatically as soon as you finalize your shopping cart and appear in the total to be paid. In the event of damage during transport, the justified protest must be made to the company within two days of delivery. Delivery times are given only as an indication; if they exceed thirty days from the date of order, the sales contract may be terminated and the customer reimbursed.

ARTICLE 7: PROCESSING OF UNDELIVERED PACKAGES BY OUR TRANSPORT SERVICE PROVIDER

These are the packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage, spoliation, etc…. Returns due to NPAI: These are packages returned by the delivery service provider under the mention: Does not live at the indicated address. After receipt and acceptance of your package by our services, the company will contact the customer in order to send back his order if the product is still available or to proceed with the refund of the order according to the customer’s wishes. The company reserves the right to proceed with the refund of the order and not the return of it in the event that several NPAIs are identified. Returns due to “NOT RECLAMED”: These are packages that have not been claimed by the customer at the post office, or at the Relais within the specified time limits. After receipt and acceptance of your package by our services, the company will contact the customer in order to send back his order at the customer’s expense if the product is still available or to proceed with the refund of the order according to the customer’s request. The company reserves the right to refund the order and not to return it in the event that several “NOT RECLAMED” are identified. Returns due to “REFUSE”: You refused your package at the time of delivery. After receipt and acceptance of your package by our services, the company will refund the amount of the order within 5 working days. In the event of the return of a package following the causes “NPAI”, “NOT RECLAMED”, or “REFUSE”, the company does not guarantee the reservation of the ordered items and may be required to refund the order if the product or products are not available.

ARTICLE 8: RIGHT OF WITHDRAWAL

The customer has a legal period of 14 clear days to exercise his right of withdrawal from the date of receipt of the goods without having to justify any reasons or pay any penalties. This applies to all products in stock and does not apply to products made to order. If this period of fourteen clear days normally expires on a Saturday, Sunday or public holiday or non-working day, it shall be extended until the first following working day. In the event of exceeding this deadline, the return costs are then paid by the customer.

ARTICLE 9: RETURN AND REFUND

The Customer has a period of 15 days from the date of delivery of the goods to exercise the right of withdrawal from his order. The postmark or the date of the receipt of availability constitutes the starting date of this period.

Exchanges are free of charge, ask us for a free return form.

Returns are the responsibility of the customer.

If your inseparable does not acclimatize well to you, you can return it to us and get a refund or exchange within 15 days.

Here are the different steps to follow to facilitate the processing of your return request:

Send us an email to contact@juch.fr with your order number and the name of the model to be refunded. In the case of an exchange, ask us for a free return form
Insert the items to be returned into a cardboard box, with a note indicating the reason for the return and your name
Leave your package at the post office. With the return address: JUCH, 39 Dauphine Street, 75006
As soon as our teams check the package for your returned order, we will proceed with the refund/exchange. The refund may take up to 30 days to appear on your account, depending on your bank or card issuer.
ATTENTION: WE ONLY TAKE BACK SHOES THAT HAVE NEVER BEEN WORN AND THAT DO NOT HAVE ANY NEW MARKS, INCLUDING ON THE SOLE!

Please take every precaution when trying on your JUCH (use a carpet or rug).

If you make an exchange, JUCH will return the new pair to you at its expense only once. If you wish to exchange your product several times, you will have to pay for the shipment to our premises.

The refund is made within a maximum period of 30 working days from the receipt of the return of the goods by re-credit on the credit card used for the purchase and this after checking the good condition of the article and its packaging. Damaged, incomplete, or soiled products will not be taken back or refunded. All returned items must be returned in perfect condition…

Upon receipt of the package, the company will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned items have been visibly used or damaged by the customer and such use or damage makes the items unfit for sale.

If the return is refused by the company, the items will then be returned to the customer at his expense, without the customer being able to claim any compensation or right to reimbursement, with the exception of the subsequent exercise of his warranty rights on the goods sold. If the returned items have been visibly used or damaged by the customer and such use or damage makes them unfit for sale, the company may take any corresponding collection action against the customer. No cash on delivery will be accepted for any reason whatsoever. In the absence of compliance with the above-mentioned procedures, no claim for non-conformity or apparent defect of the delivered products can be accepted.

ATTENTION: WE ONLY TAKE BACK SHOES THAT HAVE NEVER BEEN WORN AND THAT HAVE NO NEW MARKS, INCLUDING ON THE SOLE!

Return of items purchased at BOUTIQUE JUCH, against credit note or exchange.

Christmas period: during the whole month of December SEND & RETURN free of charge within 30 Days

Outlet / private sale: non-refundable and exchange at the customer’s expense

ARTICLE 10: OBLIGATION OF THE PARTIES

JUCH, in the event of acceptance of an order, undertakes to sell and deliver to the Customer the products ordered by the latter according to the terms specified above. JUCH undertakes to check that the products comply with French regulations. The Customer undertakes to provide JUCH with an address to which delivery can be made. The information of personal information (name, address, telephone, e-mail address…) collected for the purpose of concluding the sales contract is mandatory. This information is essential for the processing and delivery of orders and the preparation of invoices. The lack of information leads to the non-validation of the order. In the event of an error in the provision of this information, JUCH cannot be held responsible for the impossibility of delivering the product. In this case, the customer remains responsible for the payment. In the event of the supply of an incomplete address resulting in the impossibility of delivery by the transport service provider, the Customer shall pay the delivery costs corresponding to the reshipment of his order.

ARTICLE 11: LIABILITY

For all stages of access to the site, consultation, filling in forms, placing orders, delivery of items or any other service, the company has only an obligation of means. Consequently, the company cannot be held liable for any inconvenience or damage inherent in the use of the Internet network and totally outside the due diligence and precautions taken. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer viruses, shall not engage the company’s liability. Similarly, any event qualified as force majeure within the meaning of the case law of the Court of Cassation totally exonerates the company from any liability.

ARTICLE 12: PROVISIONS OF THE “INFORMATIQUE ET LIBERTÉS” LAW

The company has declared the file containing personal data relating to customers of the www.juch.fr website to the Commission Nationale Informatique et Libertés (declaration N° 1530782) in accordance with the provisions of the Loi Informatique et Libertés of 6 January 1978. Under this law, the customer has the right to access, rectify or oppose the personal data collected concerning him/her. The invalidity or inapplicability of one of the clauses of these general terms and conditions of sale or of the special conditions shall not affect the application or validity of the other clauses of the general terms and conditions of sale. This clause will then be replaced by the closest possible provision. Neither JUCH nor the Client may be held liable in the event of contractual non-performance following a case of force majeure, in particular and without limitation in the event of war, riot, insurrection, transport interruption, import problems, strikes, shortages, fires, earthquakes, storms or floods. ARTICLE 15: APPLICABLE LAW

These conditions are governed by French law. The French courts have territorial jurisdiction to hear any dispute relating to the use of the site.
